Urgent measures approved by the Government of Spain to favor the temporary hiring of workers in the agricultural sector (13/04/2020)

The Department of Promotion and Employment recalls that the Council of Ministers approved on April 7 the Royal Decree-Law 13/2020, by which certain urgent measures are adopted in the field of agricultural employment, which will favor the temporary hiring of workers in the agricultural sector and guarantee the availability of labor to meet the needs of farmers and ranchers.

The objective is to ensure the collection on farms, the productive flow for the later links of the chain and the supply of the population due to the sharp decrease in the supply of labor that usually deals with agricultural work as a temporary worker in the Spanish countryside, due to sanitary limitations on travel from their countries of origin as a consequence of COVID-19.

The urgent measures allow the compatibility of unemployment benefit or other social or labor benefits with the performance of agricultural tasks, so that sufficient labor is achieved in the current situation by the population near the places of cultivation and the increase in disposable income at a time of special vulnerability, without undermining social protection and public health.

In this way, persons who, upon the entry into force of the Royal Decree-Law, are in a situation of unemployment or cessation of activity and those workers whose contracts have been seen may be beneficiaries of the temporary flexibility measures. temporarily suspended, as a result of the temporary closure of the activity, in accordance with the provisions of article 47 of the revised text of the Workers' Statute Law, except for workers affected by ERTES due to COVID-19.

Those migrants whose work permit ends in the period between the declaration of the state of alarm and June 30, 2020, may also access these jobs, whose extension will be determined through instructions from the Secretary of State for Migration.

Young nationals of third countries, who are in a regular situation, who are between 18 and 21 years old, may also be admitted.

In addition, to access this type of contract, the regulation establishes that people whose addresses are close to the places where they carry out the work may benefit from the flexibility measures.

It is considered as a requirement for the employer the need to ensure, at all times, the availability of appropriate means of prevention against COVID-19.

The remuneration received for the work activity performed, under the extraordinary measures to make employment more flexible, will be compatible with different unemployment benefits.

The competent Administrations and the social agents will promote the hiring of people who are in the circumstances described above, especially regarding proximity.

In this way, the job offers that need to be covered in each locality will be communicated by the companies and employers to the competent autonomous public employment services, which will manage them with the beneficiaries to give them urgent coverage.

Lastly, Royal Decree Law 13/2020, rewrites article 17 of Royal Decree-Law 8/2020, specifying the scope of protection and accreditation of the necessary requirements to receive the extraordinary benefit for self-employed workers (lower income). 75%) for certain activities that receive their income unevenly over campaigns or time periods exceeding the six-month period, which is the time comparison parameter that constitutes the general rule.

Thus, the flexibility approved last week for agricultural and cultural activities or public shows is extended to those included in the Special Regime of the Sea. All of them will be governed by other calculation periods.

As stated in the amendment to the rule, this extraordinary benefit for cessation of activity will last for a month, extending, where appropriate, until the last day on which the alarm state ends.

The Royal Decree-Law 11/2020, of March 31 regarding the moratorium of quotas for companies and self-employed, is also amended, which adopts urgent complementary measures in the social and economic field to face COVID-19 to include some points.

The moratorium, in the cases that it is granted, will only affect business contributions in the contribution to Social Security and for concepts of joint collection, as well as the quotas of self-employed or self-employed workers.
