Approved the draft of the Social Services Law of the Region of Murcia, opening the hearing period to interested parties and the population in general related to this field of action in this Autonomous Community (19/07/2018)

The Governing Council has approved a few days ago the draft Law of Social Services of the Region of Murcia, which now begins its administrative processing, through the process of information and participation to the population in general, to entities related to Social Services, to the rest of councils of the regional Administration and to different advisory bodies, according to sources of the Council of Social Welfare. The norm is necessary to adjust to the current social reality.

The approval of different regulations (such as the Dependency Law or the Basic Income Law), social changes and new needs as a result of migration phenomena, the aging of the population and the need to support families, as well as the need to improve Social Services make the approval of a new law essential.

In order to comply with the hearing procedure of the aforementioned draft bill addressed to the interested parties in general, the corresponding announcement has been published in the Official Gazette of the Region of Murcia, opening a period of fifteen days, starting from day following the publication of the announcement in the BORM.

During the indicated period, the interested or affected persons may present the allegations and observations they deem appropriate by telematic means in the Electronic Headquarters of the Autonomous Community of the Region of Murcia through the specific form of allegations provided for the hearing procedure of the procedure 1549 "elaboration of normative dispositions" included in the Guide of Procedures and Services of the web page of the CARM, without prejudice to the provisions of article 16 of Law 39/2015, of October 1, of the Common Administrative Procedure of the Public Administrations.

The aforementioned draft law and the memory of impact analysis that accompanies it, will be available to the public at the headquarters of the Ministry of Family and Equal Opportunities, located on Avenida de la Fama, 3 in Murcia, and may also be consulted in the following link of the website of the Transparency Portal: https://transparencia.carm.es/web/transparencia/anuncios-informacion-publica

For this purpose, as a person, entity, organization or association directly interested or affected or that groups or represents their interests, an individualized hearing process is carried out during the same period in order to be able to formulate the observations it deems appropriate.

Among the novelties of the regulation, which will repeal the current Law 3/2003, April 10 of the Social Services System of the Region of Murcia, highlights the concept of 'subjective right to so-called guaranteed benefits', recognition that assumes that people holders may claim administrative and judicial compliance with the right to benefits and services recognized by law.

Guaranteed benefits will be included in the Social Services Catalog of the Law.

The preliminary draft includes the principles of universality in access and equality, personalized attention (according to the specific needs of the recipients of the system) and integral, as well as continuity and equity.

To comply with the principles, new fundamental instruments are regulated: the Unique Social History, the Individual Social Care Program, the Reference Professional, the Social Information Card, the Social Services Information System and the services map. the territorial organization of Social Services have been configured at two levels: Primary or first level of care and Specialized or second level of care.

The law, according to the preliminary draft, is comprised of 114 articles, 3 additional provisions, 6 transitional provisions, a derogatory provision and 4 final provisions. Finally, the new law promotes social participation, incorporating, together with the participation bodies and existing (such as the Regional Council of Social Services) the Support Table for the Third Sector, with the aim of institutionalizing collaboration, cooperation and dialogue between the Administration and the Platform of the Third Sector.
